How Retail Currency Trading Is Regulated, Jurisdiction by Jurisdiction
The marketing rules matter as much as the product rules and attract far less attention.

A currency broker's website looks much the same from London, Chicago or Singapore. The legal entity behind it does not. Retail currency trading is a licensed activity, and the licence belongs to a national company answering to a national supervisor that sets the leverage cap, the capital requirement and the protections that apply when something goes wrong. Two clients of the same brand, in two countries, can hold products that differ in structure, cost and recourse. For anyone comparing providers, the entity named in the footer is a more informative field than the spread table above it.

The United States: the narrowest perimeter

American rules define the market by exclusion. A firm taking retail currency business must register with the Commodity Futures Trading Commission as a retail foreign exchange dealer or a futures commission merchant and hold membership of the National Futures Association, which carries an adjusted net capital floor of twenty million dollars plus a percentage of client liabilities above that figure. Leverage is capped at 50:1 on major pairs and 20:1 elsewhere. Orders close first-in, first-out, and one account cannot hold opposing positions in the same pair.

Contracts for difference do not appear anywhere in that framework, because they are not available to US retail clients at all, and readers of internationally written comparisons are regularly caught out by the omission. What is available is spot and forward currency contracts, exchange-listed futures, and spot crypto through separately regulated arrangements. Registration status is public and worth establishing before any other criterion: the US entity behind currency trading with OANDA states its CFTC registration and NFA membership number on its own pages, and that number resolves in the NFA's BASIC register, which carries any disciplinary record attached to it.

The United Kingdom and the European Union: intervention as the baseline

European supervision took the opposite route. CFDs remain available to retail clients, but their terms are dictated rather than negotiated. Product intervention measures introduced by ESMA in 2018 and made permanent by national regulators, the FCA among them, cap leverage at 30:1 on major currency pairs and step it down by asset class: 20:1 on major indices and gold, 10:1 on other commodities, 5:1 on single equities, 2:1 on cryptocurrencies. Alongside the caps sit negative balance protection, automatic closure of positions when margin falls to half the required level, a prohibition on trading bonuses, and a standardised risk warning carrying the firm's own percentage of losing retail accounts. The percentage is firm-specific rather than generic, and it sits on the same page as the authorisation details, so a UK landing page usually carries both the loss figure and the FCA firm reference number to check it against, which makes verification faster in Britain than in most other jurisdictions.

The marketing rules matter as much as the product rules and attract far less attention. Under the UK financial promotion regime, a communication inviting investment activity must be issued or approved by an authorised firm, which turns an unapproved comparison page into a regulatory problem for whoever published it rather than a grey area to be argued about afterwards.

Asia-Pacific: licensed, on local terms

Singapore's Monetary Authority licenses the activity under the capital markets services regime and cut retail leverage on currency pairs to 20:1 in 2019, the tightest ceiling among the major hubs after the United States. Australia held out longest: ASIC imposed a 30:1 retail cap only in March 2021, after years in which Australian-licensed entities served international clients on terms unavailable to Australians themselves. That sequence explains why offshore licences from the period still circulate in comparison to content that nobody has updated since. Both regimes require the licensed entity to identify itself on the site a client actually lands on, and the capital markets services licence behind a Singapore-facing operation is published with its company registration number in the same place, which is the identical verification path used in Chicago or London and takes no longer.

Same brand, different counterparty

The regimes diverge most sharply on what happens if the firm fails. UK-authorised firms fall under the Financial Services Compensation Scheme, which covers eligible claims up to eighty-five thousand pounds per person per firm. EU member states run investor compensation schemes built on a twenty-thousand-euro minimum, implemented nationally. US retail forex has no equivalent at all: client funds sit under segregation rules, but no insurance scheme stands behind them, and SIPC coverage does not extend to currency positions. A brand operating in all three markets gives all three answers at once, and which one applies depends solely on the entity that signed the client agreement.

Where to check, and how long it takes

Verification is public in every one of these jurisdictions and none of it requires an account. NFA BASIC covers US registrations and disciplinary history. The FCA Register lists UK authorisations and the specific permissions attached to them. National registers, the Polish KNF list among them, cover EU entities and passported services. MAS publishes its Financial Institutions Directory, and ASIC Connect covers Australian licences. Each search takes under a minute and answers the question no spread comparison addresses: which company the money is with, and what stands behind it if that company stops trading.
